Privacy Policy
How Moka3ab collects, uses and protects your personal data, and the rights you have under Moroccan Law No. 09-08.
This Privacy Policy explains how Moka3ab ("we", "us"), a digital agency based in Tétouan, Morocco, processes personal data collected through this website and our forms. It is provided in accordance with Moroccan Law No. 09-08 on the protection of individuals with regard to the processing of personal data, and the recommendations of the CNDP (Commission Nationale de contrôle de la protection des Données à caractère Personnel).
1. Data controller
The data controller is MOKA3AB SARL, a limited liability company under Moroccan law, registered office Av Jbal Tadghin, Rue 04 N°19, Tétouan 93000, Morocco (RC Tétouan 13217, ICE 000064273000056). 2. What data we collect
We only collect data you choose to give us and the minimum technical data needed to run the site securely:
- Contact and quote forms (contact form, free-audit form, checkout form): your name, WhatsApp number, email address, the URL of your current website if any, and the details of your project or request.
- Billing information, where you request an official invoice: company name, address and ICE / tax identifiers.
- Technical data collected automatically by our server and security tools: IP address, browser and device type, pages viewed, date and time, and referring page.
- Cookies and similar technologies, described in section 5.
We do not knowingly collect sensitive data (health, religion, political opinions, etc.). Please do not include such information in your messages.
3. Why we use your data and on what basis
- To answer your enquiries, prepare quotes and schedule calls — on the basis of your request and pre-contractual steps.
- To provide, deliver and invoice our services — on the basis of the contract between us.
- To keep the website secure and prevent abuse and spam — on the basis of our legitimate interest.
- To measure audience and improve the site — on the basis of your consent, where required.
- To meet our legal and accounting obligations.
4. Who has access to your data
Your data is handled by Moka3ab's team and is never sold or rented. We share it only with service providers who help us operate, and only as far as needed:
- Hosting: Hostinger International Ltd (61 Lordou Vironos Street, 6023 Larnaca, Cyprus) hosts the website and its database.
- Google: reCAPTCHA (spam and bot protection on forms) and Google Analytics (audience measurement) — see section 5.
- Email provider: used to send and receive the messages related to your request.
Some of these providers operate servers outside Morocco (notably in the European Union and the United States). Where that is the case, the transfer is governed by the providers' own contractual and technical safeguards.
5. Cookies and similar technologies
- Strictly necessary cookies: a session cookie set by our platform so the site and its forms work. These cannot be switched off.
- Google reCAPTCHA (v2 and v3): loaded on pages that contain a form to tell humans from bots. Google may set cookies and collect device and usage information for this purpose. See Google's Privacy Policy and Terms.
- Google Analytics 4: sets
_gaand_ga_*cookies to measure visits and how the site is used, in aggregate. Data is retained for about 14 months. You can refuse these cookies through your browser settings or by installing the Google Analytics opt-out add-on.
6. How long we keep your data
- Enquiries that do not become projects: up to 24 months after the last contact.
- Client files, contracts and invoices: for the retention period required by Moroccan commercial and tax law (generally 10 years).
- Server and security logs: up to 12 months.
- Analytics data: about 14 months.
7. Security
We use HTTPS encryption, access controls, spam filtering and regular updates and backups to protect your data against loss, misuse or unauthorised access. No system is completely secure, but we take these obligations seriously.
8. Your rights
Under Law 09-08 you have the right to access your personal data, to have it corrected or updated, to object to its processing on legitimate grounds, and to ask for it to be deleted. To exercise these rights, email [email protected]; we may ask you to confirm your identity. You also have the right to lodge a complaint with the CNDP (www.cndp.ma).
9. Children
This website is intended for professionals and business owners. We do not knowingly collect data from minors.
10. Changes to this policy
We may update this policy to reflect changes in our services or the law. The current version and its date are always shown at the top of this page.
